Oral arg. – MSSC – 9/25/2018

At 1:20, the MSSC will hear Michael and Vickie Kansler v. Miss. Dep’t of Revenue

In January 2015, the Kanslers concluding a  New York audit and  filed amended 2008 and 2009 Mississippi income tax returns seeking a refund of $257,140 which was denied because of Mississippi’s three year statute of limitations for refunds, MCA Section 27-7-313. The Kanslers appealed arguing that  the statute is unconstitutional “in the narrow context of the double taxation it produces for certain Mississippi residents earning income in interstate commerce.”
