Oral arg. – COA – 8/23/2018

At 10:30 the COA will hear the case of Showanda Palmer on behalf of the wrongful death beneficiaries of Nathaniel Moore v. Clark Clinic, Scott Regional Medical Center, and Dr. George Ziakas.  Palmer filed a medical malpractice case alleging that the defendants prescribed her father a drug for his hip pain and that the drug caused severe bleeding and death by heart attack.  The trial court granted summary judgment finding that the case was filed after the statute of limitations had passed.  On April 11, 2017, the trial court denied Palmer’s request for hearing.  Two days before the deadline to file a notice of appeal expired, Palmer’s lead lawyer quit the law firm.  Six days after the notice of appeal should have been filed, another lawyer for the firm requested an extension of time to file the notice of appeal. The trial court denied the motion and Palmer appealed the denial.

  1. Any idea what’s been screwy about the court’s oral argument system lately? Today’s COA argument, and a couple last week started up halfway through the argument. They occasionally have had that problem before, but it seems to be the norm nowdays.

    • No. I’ve been trying to view them on my phone quite unsuccessfully and finally managed to watch with my tablet but I did not notice them starting late. Theoretically you can watch them even after they are done but that was easier to do when they were on Youtube.
