At 1:30 the court will hear the death penalty case of Terry Pitchford v. State. Pitchford was convicted of capital murder and sentenced to death. The case was affirmed on direct appeal. On post conviction, the court held that he should have been given a competency hearing and remanded for a hearing to determine whether Pitchford had been competent during his 2006 trial. After a hearing, the trial court held that Pitchford had been competent. Pitchford appealed. He argues that the hearing was inadequate for various reasons.
