Oral arg. – COA – Jan. 18, 2017

At 10:00 the COA will hear the sex discrimination case of  case of Ola C. Kirk v. Mississippi Department of Public Safety.

Kirk applied for the position of lieutenant with the Department of Public Safety in 2013.  When she was denied promotion, she sued claiming gender discrimination. Both the Employee Appeals Board and the Circuit Court found against Kirk and she appeals.

At 1:30 the Court will hear the dental malpractice case of Nancy Pigott v. Jeffrey Young Taylor, DMD.

Pigott sued Dr. Taylor claiming that his placement of a dental implant in 2009 was negligent in that it impinged on a nerve.  After the surgery she was in pain and Dr. Taylor attempted to reposition the implant.  In 2013, she sought the services of Dr.  Ronald Prehn, D.D.S., regarding the implant.  He told her that the wrong implant had been used and that it was impinging on a nerve.   Pigott filed suit against Dr. Taylor on _____. The circuit court found the suit barred by the statute of limitations and Pigott appeals. She argues that there are fact issues surrounding when she should have known that Dr. Taylor committed malpractice.
