Oral arg. – COA – Sept. 15, 2016

 

At 10:00 the COA will hear Kent Holifield and Laurie Holifield v. City Salvage, Inc. 

In 2009, the Holifields purchased a house built in  2008 by Defendant Ronny Hill Construction, Inc. located in Laurel.  They claim that in 2011, they discovered the existence of Chinese-manufactured drywall in the walls of their home and that they suffered damages as a result.  City Salvage sold drywall to Ronny Hill Const. City Salvage purchased the drywall from Defendant Gulf Coast Shelter, Inc..   City Salvage filed a third-party complaint against Gulf Coast for selling  the allegedly defective Chinese drywall.

City Salvage filed a motion for summary judgment arguing that it was  an “innocent seller” under the MPLA.  The trial court granted City Salvage’s motion and the Holifields appealed.
