At 1:30 the COA will hear Monica Harris v. The Town of Woodville
Monica Harris was a police officer for the Town of Woodville. She sued the Town under the Tort Claims Act for assault and battery, negligent and/or intentional infliction of emotional distress, common law harassment, failure to properly train, failure to properly supervise, and conspiracy. The claims arose after a meeting she was in with some co-workers where one of them slapped her on the butt. Her co-workers had been discussing the size of her butt prior to Harris entering the meeting. The co-worker, Stewart, ended up pleading nolo contendere to simple assault.
In defending the suit, the Town argued that Stewart was not acting within the scope of his employment. The specially appointed judge, Breland Hilburn, granted summary judgment to the Town on this basis and Harris appealed.
